PRODUCT WARRANTY

SEVEN YEAR LIMITED WARRANTY

1. Subject to the conditions and limitations set out in this warranty below, The Laminex Group. A division of The Laminex Group Pty Limited ABN 98 004 093 092, warrants to the original purchaser of any Readikit® Modular Kitchen Solutions product for interior residential use that The Laminex Group will, at its option, repair or replace that product without charge if it fails during the first 7 years after initial purchase (proof of purchase will be required). Subject to paragraph 8, this obligation terminates at the expiration of 7 years from the date on which the Readikit Modular Kitchen Solutions product concerned was first purchased from The Laminex Group.
2. This limited warranty does not cover damage caused by:
   1. any act of God, any natural occurrence, or any other act or circumstance beyond The Laminex Group’s control; or
   2. failure to follow any procedures recommended by The Laminex Group for the fabrication, assembly and installation of the Readikit Modular Kitchen Solutions product; or
   3. physical abuse, misuse, accidents, exposure to excessive heat, exposure to excessive moisture, exposure to excessive weight placed in, on, surrounding or attached to product, the use of solvents, abrasives, unsuitable cleaning agents or corrosives, improper maintenance, normal ‘wear and tear’, scratches, scuffs, burns, stains, wipe marks on darker colour or glossy or smoother surfaces; or
   4. incorrect cabinet assembly, end, infill, multipurpose and breakfast bar panel installation, hinge and drawer installation, and/or adjustment, incorrect cabinet, cabinet leg, cabinet accessory, kickboard, kickboard overlay, benchtop, benchtop cut-out, door or handle installation, incorrect wall fixing methods or components, incorrect installation with respect to kitchen and/or other appliance manufacturer’s specifications, within the environment in which they are installed, or
   5. general fading and discolouration (exposure to direct sunlight should be avoided); or
   6. the product being used in applications that are not recommended by The Laminex Group in the product literature published by The Laminex Group; or
   7. faulty workmanship, storage and/or handling by any person subsequent to supply of the Readikit Modular Kitchen Solutions product from The Laminex Group; or
   8. incorrect or unsuitable structural, building, electrical, plumbing, gas, plastering, flooring, tiling and appliance installation or failure to comply with Australian and local building and industry codes and standards and appliance manufacturer’s specifications, applicable to the environment in which Readikit Modular Kitchen Solutions products are assembled and installed; or
   9. variation in colour, pattern, shade of material against the sample material, displays and/or printed illustrations.
      
      This warranty does not cover:
   10. where the defect is trivial or insubstantial; or
   11. where, as at the date of notification of the defect to The Laminex Group, the type or colour of the alleged defective product no longer forms part of The Laminex Group’s standard stock range and the person complaining of the defect does not agree to the supply of a replacement which is as close a type of colour match as is possible from The Laminex Group’s then prevailing stock range; or
   12. where the defect has been disclosed as a feature of limitation of the Readikit Modular Kitchen Solutions product in any literature published by The Laminex Group; or
   13. outdoor application.
3. This warranty applies only to Readikit Modular Kitchen Solutions products with the following criteria:
1. purchased from your Readikit Modular Kitchen Solutions Retailer after January 2007, for interior residential use in Australia;
2. which have not been moved from their original place of installation;
3. which have been installed, maintained, used and protected in the manner recommended by The Laminex Group in its published literature concerning those products, a copy of which may be obtained, free of charge, by writing directly to The Laminex Group at the address given below.
4. This warranty will cover reasonable labour charges which are necessary for the repair or replacement of any Readikit Modular Kitchen Solutions product covered by this warranty.
5. A replacement from The Laminex Group may not be reasonably available in the same shape, type or colour as the original Readikit Modular Kitchen Solutions products covered by this warranty. If a replacement product from The Laminex Group of the same shape, type or colour is not reasonably available The Laminex Group reserves the right to provide a replacement product of as close a shape, type and colour match as is reasonably possible from The Laminex Group’s then prevailing product range in satisfaction of its obligations under this warranty.
6. This warranty will only apply if The Laminex Group is notified in writing within 30 days of the holder of the warranty becoming aware of the product failure.
7. Except as expressly provided in paragraphs 1 and 8, all terms, conditions, warranties, undertakings, inducements and representations, whether express or implied, statutory or otherwise relating in any way to any Readikit Modular Kitchen Solutions products are excluded. Without limiting the generality of the preceding sentence, The Laminex Group will not be under any other liability in respect of any loss or damage (including consequential loss or damage) however caused (whether by negligence or otherwise) which may be suffered or incurred, or which may arise directly or indirectly in respect of any Readikit Modular Kitchen Solutions product.
8. Where applicable legislation implies any term, condition or warranty into The Laminex Group’s relationship with a person who has acquired any Readikit Modular Kitchen Solutions product, or otherwise gives that person a particular remedy against The Laminex Group, and that legislation or any legislation voids or prohibits any provision excluding, or modifying the application of, or exercise of, any liability under such term, condition, warranty or remedy, such term, condition, warranty or remedy shall be deemed to be included in or, as the case may be, apply to that relationship. However, The Laminex Group’s liability for any breach of such term, condition, or warranty, or under such remedy, shall be limited, at The Laminex Group’s option, to any one or more of the ways permitted by the legislation, including, where so permitted if the breach relates to any Readikit Modular Kitchen Solutions products:
1. the replacement of that Readikit Modular Kitchen Solutions product or the supply of equivalent Readikit Modular Kitchen Solutions product;
2. the repair of that Readikit Modular Kitchen Solutions product;
3. the payment of the cost of having that Readikit Modular Kitchen Solutions product repaired;
4. the payment of the cost of replacing that Readikit Modular Kitchen Solutions product or
   acquiring equivalent product.
   
9. Please note that in addition to this warranty the law may confer rights arising out of the supply of Readikit Modular Kitchen Solutions products. This warranty should therefore not be read as an exhaustive statement of the rights of the original purchaser or any other person.
10. This warranty does not cover any other product used or installed in connection with Readikit Modular Kitchen Solutions products.
11. This warranty is not transferable or assignable.
